KAMPALA- Court has heard that Eddy Sebuufu aka Eddie Mutwe, the arrested bodyguard to the Kyadondo East MP Robert Kyagulanyi alias Bobi Wine is to be transferred to Gulu court to face treason charges in relation to stoning of the presidential motorcade during the final rally to fill the vacant Arua Municipality MP seat.
Eddie Mutwe will be the 35th suspect to join the charge sheet which already includes his boss Bobi Wine and 4 other MPs.
High Court Judge Musa Sekaana was informed about the new development today September 4 by Attorney General’s representative, Mr Peter Tusubiira as he had come to update court on the whereabouts of Eddie Mutwe.
Last week, Justice Sekaana ordered the CDF Gen. David Muhoozi , CMI and Attorney General to bring Eddie Mutwe before the court today without fail after his (Mutwe) lawyer Eron Kiiza petitioned court seeking his unconditional release.
Mr Anthony Kusingura of Kiiza Mugisha Advocates filed a habeas corpus in court saying operatives of the Special Force Command arrested Eddie Mutwe on August 25 from Ssemakokiro plaza in Kamwokya within Kampala.
A habeas corpus application was made seeking Eddie Mutwe under detention to be brought before a judge or magistrate but mainly to secure that his release unless lawful grounds are shown to justify their continued incarceration.
Kusingura said that Eddie Mutwe has been unjustly deprived of his fundamental human right to liberty and should be produced him in court within 48hrs of arrest as it’s enshrined within the constitution.
“No charges have been brought against Eddie Mutwe in any competent court of law and no explanation has been accorded to him or his next of kin for his continued detention,” he said.
“The military has ensured that he remains incommunicado since his arrest and his kin and kith are anxious about his state of health given the mistreatment and torture most recently visited on the person of his friend and boss Bobi Wine,” added Kusingura.
