
KAMPALA-The minister for science and technology and the newly elected MP for Sheema Municipality Dr. Elioda Tumwesigye has been dragged to court for allegedly dodging summons that require him to file a response in an election petition instituted against him.
In her law suit before the High Court civil division, Ms Plan Virginia Mugenyi through her lawyers of Isabirye and company advocates, says since September 6, 2018, she has been looking everywhere for Dr. Tumwesigye for purposes of serving him with a copy of the petition and summons issued by the High court at Mbarara but in vain.
Mugenyi now seeks the Highcourt to grant her permission serve the petition and summons to Minister Tumwesigye through media out-lets else the time with in which she is supposed to effect service lapsed yesterday September 12, 2018.
The law governing parliamentary Elections petitions (PEA) requires that a physical copy of the petition and summons are served and received directly to the respondent.
Mugenyi who contested as a candidate in the Sheema Municipality MP race filed an election petition at the High court in Mbarara seeking to nullify the election of Dr. Tumwesigye whom she accuses of engaging in multiple electoral offenses including bribery of voters and assaulting her supporters .
Mugenyi who was returned second in the said election further faults the Electoral commission of nominating and declaring Dr. Tumwesigye as winner of the Sheema Municipality MP post well knowing that he had not withdrawn his representation as Sheema North MP.
