
KAMPALA – The Parliamentary Commission has been dragged to court over alleged deduction of money from an account of a former legislator without his consent.
Mr Tonny Kipoi Nsubuga in his court documents filed before the High Court says that he was the Bubulo County West MP between July 2011 and April 2014 before the committee on Rules, Privileges and Discipline declared his seat vacant in the 9th Parliament.
He explains that during his tenure as a legislator, his account held with the Parliament of Uganda accumulated emoluments totalling to UGX 254.3 million and mileage allowances of UGX 214.2 million being his payables that he did not spent.
Kipoi states that the Parliamentary Commission being the custodian of his account deducted his money amounting to UGX 468.5 million without his knowledge, authority and or consent thereby depriving him of his income.
Kipoi accuses the Parliamentary Commission of fraud which he says forged his signature on various transactions leading to the withdraw of money from his account.
He also accuses the Parliamentary Commission of concealing information about the transactions in question, creating of ghost recipients in order to drain his money, using an unauthentic and forged instrument like powers of attorney to siphon money from his account.
Kipoi says that the actions of the commission or its agents were done in bad faith, illegal and unjustifiable.
Kipoi says that the Parliamentary Commission should be held liable for depriving him of his income leading to loss of capacity to perform his legislative work, duties, social contract and his decent source of earning as a legislator.
Kipoi says that he will seek for special damages and interest at a commercial rate for the deduction of his money without his knowledge, authority and consent and a declaration that the Parliamentary Commission breached his privilege when it failed under its obligation to uphold his welfare as an honourable member of the 9th parliament.
Kipoi’s case file has been allocated to Justice Musa Sekaana for hearing.
