
KAMPALA – EgyptAir Corporation is in trouble after a woman dragging the company to Commercial Court for allegedly failing to deliver her client’s wedding gifts to the United States of America.
Jackeline Ntarutaimana is seeking for UGX50 million from the company as compensation for the damage and losses she incurred when the company failed to deliver her goods worth UGX10 million to her client.
According to the court documents seen by PML Daily, Ntarutaimana paid the company about UGX400000 as a shipping fee with assurance from the company that her goods would reach their final destination within three days from the date of service since they were urgently needed with a tight deadline.
Court documents further indicate that on April 7, 2016, the said goods were delivered at Entebbe Airport, cleared and released for export to New York John F Kennedy Airport from which they would be delivered to the client.
Ntarutaimana explains that on several occasions since April 12, 2016, she painfully requested for the status of her goods to which the company kept tossing her until when the subject matter of the goods was officiated on April 29, 2016, without the said goods.
She says that due to the company’s conduct and omission, her contract was terminated to which she was condemned in payment of damages with a refund of the contract price now to a tune of USD10000 (about UGX36M). However, up to date, the goods have never been delivered.
Ntarutaimana says that the company’s conduct is wrongful and amounts to a breach of contract for which she is entitled to rescind the same after suffering loss.
Through her lawyers of Crimson Associated Advocates, Ms Ntarutaimana is seeking for recovery of UGX50 million which she says is the value of her claim now, special damages, costs.
She is also seeking for a declaration that the company breached the contract executed between it and her, recovery and or refund of the money equivalent to the goods worth sent through the company.
