The Mwanga II Magistrates Court has committed Luggya Bbosa Tabula, his herdsman Lujja Noah, and Tabula’s siblings Harriet Nakiguli, Joseph Nakabale and Ezra Mayanja to the High Court for trial.
They are accused of murdering Ndiga Clan Leader Engineer Daniel Bbosa Lwomwa.
The Director of Public Prosecutions (DPP) Jane Francis Abodo discontinued murder charges against Milly Naluwenda, Secretary of the Kisekwa Cultural Court of Buganda Kingdom.
Chief State Attorney Lillian Omara represented the DPP, informing Senior Principal Magistrate Grade One Adams Byarugaba that investigations were complete.
The DPP presented overwhelming evidence, including a gun (AK47 assault rifle) recovered from Lujja Noah, the motorcycle used by assailants with disguised number plates (UEX 754E), Enock Sserunkuuma’s mobile phone, call data records showing constant communication between Tabula, assailants and siblings, CCTV footage capturing Lwomwa being trailed by assailants, audio and video clips of Tabula declaring himself the mastermind, records of planning meetings chaired by Tabula to kill Lwomwa with poison.
The DPP will state before the High Court that on 25th / February at round 5. 55pm, 2 unknown gunmen travelling on a motorcycle with a disguised Number plate – UEX 754E shot dead Kakeedo, the leader of the Ndiga clan as he approached his gate/ residence.
After the said murder, the assailants fled the scene using the same motorcycle but angry residents pursued them, lynched one other who was later identified as Enock Sserunkuuma alias Munaku and rescued another Lugya Noah alias Ffeke from the angry mob.
An Ak 47 gun, a mobile phone, and a bag were recovered from the two assailants and later the body of the murdered Eng Kakeedo was conveyed to Mulago hospital where a postmortem was carried out and the cause of death was established as gunshot wounds.
Motive and Confession
Tabula allegedly provided the murder weapon, sold his sister’s land to facilitate the crime, and confessed to masterminding the murder. He claimed Lwomwa robbed him of his birthright and ancestral entitlement. Tabula had previously attempted to remove Lwomwa through the Buganda Kingdom judicial system but was unsuccessful.
The DPP argues the accused have no valid defense. Magistrate Byarugaba committed the accused to the High Court, forwarded the case file, and sent them back to Luzira prison to await trial.
The prosecution will seek a conviction, arguing the accused intentionally caused Lwomwa’s death.
