Lawyers representing Dr. Kizza Besigye have requested the General Court Martial to order the production of Eron Kiiza, a member of their team who was sentenced to nine months in jail for contempt of court.
The request came as the case against Besigye and his co-accused, Obeid Lutaale, resumed, with the lawyers raising concerns about access to the court, changes in the court panel, and the intimidation of their team members.
Lead Counsel Martha Karua expressed happiness that the court has allowed easier access and seating arrangements for the lawyers. However, she sought assurances that the court would not intimidate the lawyers in the future, citing the summary conviction and sentencing of Eron Kiiza as a cause for fear and intimidation.
Lawyer Erias Lukwago emphasized the importance of Eron Kiiza’s presence, arguing that his absence infringes on the accused’s right to full legal representation. Lukwago requested that Kiiza be allowed to attend court proceedings and resume his duties, even if he returns to prison afterward.
The court, however, declined the request, stating that Eron Kiiza, as a convict, cannot execute legal duties. The Judge Advocate reinforced that the Court Martial should be referred to as a “court” and not a “tribunal,” warning that using the latter term would be considered contempt of court.
The case has raised concerns about the military court’s jurisdiction over civilians and the treatment of lawyers representing the accused.
