
KAMPALA – The Deputy Attorney General Jackson Kafuuzi has confirmed that the files of civilians, including detained opposition politician Dr. Kizza Besigye and his aide Obeid Lutale, have been transferred from the Court Martial to the Office of the Director of Public Prosecutions (DPP).
This move follows the Supreme Court’s January 31 ruling, which declared the trial of civilians in military courts unconstitutional.
According to Kafuuzi, the transfer has been done, and technical teams will review the files to advise on the next course of action.
Besigye, a four-time presidential contender, was arraigned before a civilian court on February 19, but was sent back to prison. His lawyers had filed a habeas corpus application, seeking his release due to government delays in implementing the Supreme Court ruling.
The High Court judge, Douglas Singiza, said he will deliver his ruling in the application not later than February 25.
Meanwhile, the DPP has constituted a team of prosecutors to handle investigative files transmitted from the General Court Martial and other military courts.
This development could mark a significant step towards resolving the confusion surrounding the implementation of the Supreme Court’s landmark decision.
Besigye’s legal team has been pushing for his release, citing unlawful detention and denying him access to better medical care outside prison.
