
The High Court in Kampala will deliver its verdict on Eron Kiiza’s habeas corpus application next Monday.
Kiiza, one of Dr. Kizza Besigye’s lawyers, was sentenced to nine months in prison by the General Court Martial for alleged gross professional misconduct.
Kiiza’s lawyers, led by Peter Walubiri, argue that the conviction and sentence were illegal and unconstitutional.
They claim that the General Court Martial lacked jurisdiction to try Kiiza, citing the Supreme Court’s landmark ruling that military courts cannot try civilians.
The Supreme Court held that military courts are not independent, as they derive their existence from the army’s High Command.
Therefore, Kiiza’s lawyers argue that his continued detention is a violation of his right to personal liberty.
The High Court’s ruling will determine whether Kiiza will be released from prison or not.
The court’s decision is expected to have significant implications for Kiiza’s case and potentially for others who have been tried by military courts.
