KAMPALA – The Uganda Law Society (ULS) has broken its silence on Dr. Kizza Besigye’s alleged unlawful detention. Despite a recent Supreme Court judgment nullifying the trial of civilians in military courts, Besigye remains in detention.
The Supreme Court’s decision in Attorney General v. Hon Michael Kabaziguruka, Constitutional Appeal 2 of 2021, nullified provisions in the Uganda People’s Defence Forces Act used to charge Besigye and other civilians. Consequently, Besigye is entitled to immediate and unconditional release.
However, High Court Judge Dr. Douglas Karekona Singiza has denied Besigye’s habeas corpus petition an expeditious hearing, contravening the Constitution and the law. This is not an isolated incident, as Judge Singiza has also denied a similar petition by the ULS on behalf of its member, Adv Eron Kiiza.
“The actions of Judge Singiza are a clear disregard for the law and human rights,” said Asiimwe Anthony, Vice President of the Uganda Law Society. “We urge the Judiciary Leadership to take immediate action to address this grave injustice, including reviewing Judge Singiza’s conduct and taking disciplinary action against him.”
Asiimwe emphasized that the international community must hold Uganda accountable for its human rights obligations. “It is imperative that we ensure justice is served and that Dr. Besigye is released unconditionally,” he added.
The ULS’s statement comes amid growing concerns about Besigye’s health and well-being while in detention. The organization’s call to action seeks to highlight the urgent need for Besigye’s release and the importance of upholding human rights and the rule of law in Uganda.
